The POCSO Act is in force in India from 2012, when it was brought into force. The POCSO Act makes the following provisions:

A. 1. Prerequisite:
Chapter I of the POCSO Act requires that a person (hereinafter referred to as “the accused”) has to be over the age of 18 years or has attained the age of 16 years by the date appointed by the court for commencement of trial.

A person is deemed to be an adult for the purpose of the provisions of the POCSO Act if he is 18 years or above, or if he is 16 years, subject to the procedure in sub-section (2) of Section 7.

B. 2. Defined:
The words and expressions defined in the POCSO Act have the following meanings:
“an offence under this section”: an offence of aggravated sexual assault, rape, carnal knowledge of a female child under 12 years, child trafficking or any other offence of child sexual abuse defined under Section 16 of the Protection of Children from Sexual Offences (POCSO) Act;
“child”: a person who is under the age of 18 years;
“custodian”: a person who has responsibility to care for, safety or safety of a child;
